Terms of Use

These terms apply to everyone who plays Plain at playplain.app, with or without an account. They are short and meant to be read. By playing, or by creating an account, you agree to them.

1. Who we are

Plain is run by [Full name] (“we”, “us”). The full address is in the legal notice (Impressum). Contact: hello@playplain.app. How we handle your data is explained in the privacy policy.

2. The service

Plain is a daily guessing game about the size of things. It is free: there is nothing to buy. To cover its costs, Plain may show ads outside the game itself. You can play as a guest or create an account to keep your progress across devices. We may develop Plain further, and add, change or remove features, as long as this is reasonable for you.

3. Who can play

Anyone can play as a guest. To create an account you must be 13 or older. If you are under 18, you need the permission of a parent or guardian to create an account and to agree to these terms, and they should read these terms with you.

4. Fair play

Plain is the same puzzle for everyone each day, so it only works if everyone plays fair. You may not:

  • use bots, scripts or other automation to play, submit answers or look them up;
  • scrape or bulk-download the game's puzzles, answer lists or other content, or access its interfaces other than through the game;
  • create or use several accounts, or share an account, to manipulate rankings, ratings, streaks or rewards;
  • exploit bugs, get around rate limits or security measures, or try to access other players' data;
  • overload, disrupt or attack Plain or its servers, or help anyone else do so.

If we have concrete indications that someone breaks these rules, we may remove the affected results, reset ratings or streaks, or suspend or delete the account involved. We choose a measure that is proportionate, take your legitimate interests into account and, where possible, tell you first and let you explain.

5. Usernames

Your username is visible to you and may be shown to other players in future features. It must not:

  • be offensive, hateful, sexual, violent or otherwise unlawful;
  • impersonate another person, brand or organisation, or suggest you are connected to Plain;
  • contain someone else's personal data, trademarks you have no right to use, advertising or links.

We may change or remove a username that breaks these rules; we'll tell you when we do and you can then choose another one. You can ask us by email to change your username.

6. Facts, availability and changes

The values in Plain are compiled with care from public sources (see Sources), but they may contain errors or become out of date. They are for entertainment and are not professional, financial, medical or nutritional advice. If you spot a mistake, please tell us; we fix confirmed errors from then on, but days already played stay as they were.

We work to keep Plain running, but as a free service we can't promise that it is always available or free of errors. Maintenance, technical problems or events beyond our control may interrupt it. Your statutory rights remain unaffected.

7. Intellectual property

The game, its concept, puzzles, texts, design, graphics and software, and the answer lists as compiled by us, belong to us or our licensors and are protected by copyright and other laws. You may play Plain and share your results (for example with the share button) for personal, non-commercial purposes. Anything beyond that, such as copying the game or its lists, needs our permission.

The underlying facts come from third-party sources. Material from them stays under its own licence, as listed with the required credits on the Sources page, and nothing in these terms limits what those licences allow. Names of films, songs, companies, products, people and other answers are used only to identify them; trademarks belong to their owners, and their appearance in Plain doesn't mean they are affiliated with or endorse Plain.

8. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and where we have given a guarantee.

For damage caused by slight negligence, we are liable only if we breach an essential contractual obligation (an obligation that makes the proper use of Plain possible in the first place and on which you may regularly rely), and only for the typical damage that was foreseeable when you started using Plain. Otherwise, we are not liable for slight negligence.

These limitations also apply to the personal liability of our representatives and the people who help us run Plain. Mandatory statutory liability remains unaffected.

9. Ending your use

You can stop playing at any time. To have your account or guest data deleted, email us; the privacy policy explains how.

We may end the use of an account, or discontinue Plain as a whole, with at least four weeks' notice in the game. We may suspend or delete an account without notice for good cause, in particular for serious or repeated breaches of these terms (see sections 4 and 5).

10. Changes to these terms

We may update these terms when there is a valid reason, such as new features, a change in the law or a court decision. We'll announce changes in the game at least four weeks before they take effect. Changes that don't disadvantage you apply from then on. For changes that significantly affect your rights, we'll ask for your agreement. If you don't agree, the previous terms continue to apply to you, but we may then end the use of your account with notice under section 9.

11. Governing law and disputes

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law doesn't deprive you of the protection of the mandatory provisions of the law of the country where you habitually live.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). If something goes wrong, please email us first; we'll try to sort it out.

If any provision of these terms is invalid, the rest remain valid, and the statutory provisions apply in its place.
